Terms of Service

1. Acceptance of Terms
By accessing or using the Liftstack platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. Description of Service
Liftstack is an email content A/B testing platform. It enables you to create content variants (subject lines, hero blocks, calls to action), assign them to campaigns via integrations with email service providers, and analyse performance using Bayesian statistical methods.
3. Account Registration
To use the Service, you must:
- Provide accurate and complete registration information
- Maintain a strong, unique password for your account
- Promptly update your information if it changes
- Not share your account credentials with others
You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access.
4. Workspaces and Team Access
The Service operates on a multi-tenant workspace model. Workspace owners control membership, roles, and permissions. Data within a workspace is isolated from other workspaces. Workspace owners are responsible for managing access and ensuring team members comply with these Terms.
5. Acceptable Use
You agree not to:
- Use the Service to send or facilitate spam, phishing, or unsolicited communications
- Upload content that is unlawful, defamatory, or infringes on intellectual property rights
- Attempt to reverse-engineer, decompile, or disassemble the Service
- Interfere with or disrupt the Service or its infrastructure
- Use the Service to process data in violation of applicable privacy laws
- Access the Service through automated means (scraping, bots) without our written permission
6. Intellectual Property
Your content: You retain all rights to the content you create and upload to the Service (snippets, campaign data, analytics configurations). You grant us a limited licence to store, process, and display your content solely to provide the Service.
Our platform: The Service, including its design, code, algorithms, and documentation, is owned by Liftstack and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.
7. Third-Party Integrations
The Service connects to third-party email service providers (such as Klaviyo, Customer.io, and Iterable) at your direction. You are responsible for your accounts with these providers and for ensuring your use of data exchanged through these integrations complies with applicable laws and the providers' own terms of service.
8. Payment Terms
Paid subscription plans are billed in advance on a monthly or annual basis via Stripe. All fees are non-refundable except where required by law. We may change pricing with 30 days' notice. If you do not agree to a price change, you may cancel your subscription before the change takes effect.
Free trial periods, if offered, will be clearly stated at the time of registration. At the end of a trial, your subscription will convert to a paid plan unless you cancel.
9. Data Processing
When you connect an email service provider integration, the Service receives, stores, and processes personal data about your subscribers (email addresses, profile attributes, engagement events). For this subscriber data:
- You are the data controller — you determine why and how your subscribers' personal data is processed, and you are responsible for having a lawful basis (such as legitimate interest or consent) to share it with Liftstack
- Liftstack is the data processor — we process subscriber data solely on your instructions and only to provide the A/B testing service
- We will not use subscriber data for any purpose other than providing the Service to you
- We will notify you without undue delay if we become aware of a personal data breach affecting subscriber data
- Upon termination of your account, we will delete subscriber data in accordance with section 11 and our Privacy Policy
The Service writes a single assignment property
(lf_assignments) back to subscriber profiles in your
ESP. This property contains variant identifiers only and does not
contain personal data. You are responsible for reviewing and
approving email templates that reference this property before
sending.

Our processing of your own personal data (account information, billing) is governed by our Privacy Policy.
10. Limitation of Liability
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, Liftstack's total liability to you for any claims arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for any indirect, incidental, special, or consequential damages.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
11. Termination
You may cancel your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, you may request an export of your data within 30 days. After this period, we may delete your data in accordance with our Privacy Policy.
12. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a California resident, the CCPA provisions in our Privacy Policy apply in addition to these Terms.
13. Changes to These Terms
We may update these Terms from time to time. We will provide at least 30 days' notice of material changes by email or by posting a notice on the platform. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
